1. Who this notice is from
Sadhana Saarthi is operated by SURYANSH PROJECT HATHA YOGA LLP, a Limited Liability Partnership incorporated under the Limited Liability Partnership Act, 2008, with its registered office at New Dwarikapuri, Shivpuri, Madhya Pradesh, India, 473551 (“we,” “us,” or “the LLP”). This disclaimer applies to everything offered through the website — Classical Hatha Yoga programs, 1:1 consultations, Tapasya preparation, the Maalish herbal oil, and the Himalayan yatras — and should be read together with our Terms & Conditions and Cancellation & Refund Policy.
2. This is not medical advice
Nothing on this website, in any program, in any consultation, or on the label or literature of the Maalish oil constitutes medical advice, diagnosis, prescription or treatment. Our teachers are yoga practitioners and instructors. They are not registered medical practitioners, physiotherapists, or mental-health professionals, and no practitioner–patient relationship is created by anything we provide.
Never disregard advice from a qualified doctor, or delay seeking it, because of something you have read here or been told in a session. If you are experiencing a medical emergency, contact your local emergency services.
3. No cure, no therapeutic guarantee
Classical Hatha Yoga is a practice of physical and inner discipline. Maalish is a traditional herbal oil for external massage, drawing on Ayurvedic and Himalayan folk practice. We describe both in terms of their traditional use and the general wellbeing people associate with them. We do not claim, and you should not infer, that any practice, program, consultation or product offered here diagnoses, cures, mitigates, treats or prevents any disease, disorder or medical condition.
In particular, and in keeping with the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, the Ministry of AYUSH advertising norms and the Advertising Standards Council of India code, we make no claim that anything offered here treats or affects any of the ailments or conditions those rules restrict. Any testimonial, case account or outcome described anywhere on this site is one individual’s experience and is not a representation of a typical result or a promise of any result for you.
4. Speak to a doctor before you begin
Consult a qualified physician before beginning any program or practice, and before using Maalish if you have sensitive skin or a known allergy, particularly if any of the following apply to you:
- pregnancy, recent childbirth, or the postpartum period;
- a cardiovascular condition, high or low blood pressure, or a history of stroke;
- a respiratory condition, including asthma;
- epilepsy or a seizure disorder;
- a spinal, joint or musculoskeletal injury, or recent surgery;
- glaucoma or a retinal condition;
- a psychiatric condition for which you are under care; or
- any medication that affects blood pressure, heart rate, balance, or blood clotting.
For a yatra, medical clearance is not optional courtesy — see section 6.
5. What you must tell us, and warrant to be true
When you are asked for health information during onboarding, consultation intake, or yatra registration, you must answer accurately and completely, and you must tell us promptly if your health changes before or during your participation. We rely on what you tell us when we decide whether a practice is safe for you and how to adapt it.
You warrant that the health information you give us is true and not misleading. If you withhold or misrepresent a condition, we may not be able to keep you safe, and — for yatras and scheduled programs — a condition later found to have been misrepresented is treated as a voluntary withdrawal under the terms in our Cancellation & Refund Policy, whenever it comes to light.
6. Physical practice carries inherent risk
Physical yoga practice carries an inherent risk of injury, including from strain, loss of balance, over-exertion, or attempting a posture beyond your present capacity. By participating you accept the risks that are inherent in the practice itself and cannot be removed by reasonable care on our part.
Practise within your own limits. Stop if you feel pain, dizziness, breathlessness or nausea, and tell your teacher immediately. Do not practise under the influence of alcohol or sedating medication.
7. High-altitude travel is a serious undertaking
Our Himalayan yatras — including Kailash Mansarovar, Adi Kailash and trekking itineraries — take place at high altitude, on remote terrain, with limited or no access to medical facilities for extended periods. Acute mountain sickness, and its severe forms (high-altitude cerebral and pulmonary oedema), are real and potentially fatal risks. They can affect fit, young and experienced travellers without warning, and prior successful high-altitude travel is not a guarantee.
Participation therefore requires all of the following, and each is a condition of travelling with us:
- an honest assessment of your own fitness and health, and any medical fitness certificate required by the relevant permit authority;
- adequate acclimatisation and preparation as instructed in the pre-departure material;
- your own travel and medical insurance, valid for the whole yatra, expressly covering high-altitude travel, emergency medical treatment and emergency evacuation.
We do not provide insurance. The cost of any medical treatment, rescue or evacuation you need during a yatra is your responsibility and that of your insurer. We may require medical clearance before departure, and we may decline or discontinue any participant’s involvement on reasonable safety grounds at any time, including during a yatra; where that happens, the refund consequences are those set out in the Cancellation & Refund Policy. Itineraries are also subject to weather, permit availability, border decisions and other conditions outside our control, as described in our Terms & Conditions.
8. What this notice does not exclude
This disclaimer asks you to accept the risks that are genuinely inherent in yoga practice and in high-altitude travel. It does not, and cannot under Indian law, ask you to give up more than that. Nothing in this notice, and nothing in our Terms, excludes or limits:
- liability for death or personal injury caused by our own negligence or that of our personnel;
- liability for fraud or fraudulent misrepresentation;
- your rights as a consumer under the Consumer Protection Act, 2019, including the right to have services rendered with due care and skill; or
- any other liability that applicable law does not permit us to exclude.
An agreement to assume inherent risk is not a waiver of our duty to take reasonable care in how we plan, staff and run what we offer, and any term of our documents that would operate unfairly against you within the meaning of section 2(46) of the Consumer Protection Act, 2019 is to be read down to the extent needed to make it fair, not treated as removing your remedy.
9. Governing law and how to raise a concern
This disclaimer is governed by the laws of India, and the governing-law and jurisdiction terms in our Terms & Conditions apply to it, without affecting any consumer remedy available to you under statute.
If anything here is unclear, if you are unsure whether a program or a yatra suits your circumstances, or if you wish to raise a grievance, write to our Grievance Officer at support@sadhanasaarthi.in. We acknowledge grievances within 48 hours and aim to resolve them within 30 days. We would always rather answer the question before you enrol than have you guess.
